Dear Sally,

 

I write with reference to the requested conditions that you would like to be added to the licence.

 

These are agreed by my clients but, I would ask for the following modest amendment to your requested conditions.

 

3. There is some concern form my clients in relation to your proposed condition here in that we offered that there would be no deliveries or removal of rubbish between 23:00 and 07:00.

 

They have expressed some concern at your requested hours in relation to set up at the premises for any events that will take place. The hours you have requested would mean that the premises would not be viable. We would be grateful if the hours that you request could be outside the hours of 08:00 to 23:00 Monday to Saturday and 08:00 to 16:00 on Sundays. My clients have very robust systems for set up and don’t feel that there will be a noise nuisance created but didn’t want to be caught by a condition once the premises are in operation. I understand that there were no complaints to your department when the premises operated under TENs and trust in the circumstances that these hours could be acceptable to you. Are you saying you could control the set up within Mon-Sat 08:00-23:00 hours and Sun 08:00-16:00 or you request the set up hours to be outside of these hours?

 

7. For the avoidance of doubt, could we amend this to read as follows:- There shall be at least one personal licence holder on site during operational hours when alcohol is being served. Details of the personal licence holder (including name and contact number) shall be displayed in a prominent position on site.

 

There wouldn’t be a personal licence holder at an operational event when no alcohol was been served. I trust in the circumstances that this can be amended. I agree to this change of wording (in italics above).

 

10. My clients would ask for this condition to be removed. I think we explained to you the brands that would be likely to book the venue in similar terms to how they operated under Temporary Event Notices previously. They don’t wish to have high visibility jackets or vests on the SIA door staff as this, they feel, would put off some of the high end operators from booking events. SIA staff will be smartly dressed and will wear their SIA badges but we would wish not to have the traditional high vis jackets or vests because of the nature of the venue and the events. I think that sounds reasonable, however can we discuss your proposal on Thursday.  I know Bryan Lewis from the Police is still maintaining I’m not sure if he has based his comments on these conditions that I have proposed.

 

I hope in the circumstances that you would find that these modest changes could be amended to your proposed conditions.
